I hope everyone had a nice week!  Below, please find our latest update on the recent immigration actions that have occurred in the last two weeks:

Proposed U.S. Department of Homeland Security (DHS) rule for pending asylum cases

On February 20th, DHS proposed a rule that would end employment authorization applications for foreign nationals with pending asylum applications.  DHS stated that the proposed rule would “reduce the incentive for [foreign nationals] to file fraudulent asylum claims so they can obtain work authorizations.”  DHS’s goal is to strengthen the vetting of asylum applications and “reduce meritless applications, processing times, and backlog.”  This rule is just another example of how employers will continue experiencing a shrinking workforce, contributing to increased competition and ongoing staffing struggles.

Termination of Temporary Protected Status (TPS) for Yemen

On March 3rd, DHS officially published the termination of TPS for Yemen in the Federal Register.  TPS benefits will be terminated effective on May 4, 2026.  However, like other TPS designations, we anticipate litigation challenging the termination.
