As we all try to make sense of the many Trump Administration’s immigration-related actions and initiatives, we hope that this resource is helpful to understand the actions that are impacting the hospitality industry.  We will email this resource to Pabian Law’s clients every other Friday.

Please note: Effective yesterday, October 30th, the U.S. Department of Homeland Security (DHS) ended the practice of automatic extensions for expiring work authorizations for foreign national nationals who file renewal applications based on certain employment authorization categories.  Instead, foreign nationals who apply to renew their employment authorization documents (EADs) will no longer receive an automatic extension of their work authorization. DHS stated that this new policy aligns with the Trump Administration’s mission of more stringent vetting and screening of foreign nationals applying for immigration benefits in the U.S. This final rule will impact employers as they will likely need to reverify workers more frequently and may face staffing shortages due to lapses in employee work authorizations while renewal applications are pending.
